Official Rules

Overview.  This Househappy Coloring Contest (the “Contest”) is a photo submission contest sponsored by Househappy Inc. (“Househappy”), which seeks to find the pictures that best capture the Thanksgiving theme.  Entrants will be evaluated on the skillful quality and festiveness of their Entry.  

Eligibility.  In order to be eligible to enter the Contest, entrants must: (a) have an active Househappy account, available at https://househappy.com/; (b) be a legal U.S. resident; and (c) be 18 years of age or older.  Void where prohibited by law. Employees of Househappy or any entity involved in the production or promotion of the Contest are not eligible to enter or win.

Entry Period. This Contest begins on November 26, 2020 at 12:01 am Pacific Time and ends at December 1, 2020 at 11:59 pm Pacific Time ("Entry Period").  Househappy's computer, or its third party service provider's computer, is the official timekeeping device for the Contest. Househappy may cancel the Contest at any time.

How to Enter.  Enter by: (A) uploading a photo image, and completing all entry information, on the Contest web page at https://landing.househappy.com/thanksgiving-coloring (the “Contest Page”); or (B) sending a photo image, along with your contact information, via email to marketing@househappy.com.  Completion of either of the foregoing, together with the photo, constitutes an “Entry.” Limit one (1) Entry per person during the Entry Period. 

Househappy is not responsible for incorrect or inaccurate Entry information, whether caused by any of the equipment or programming associated with or utilized in the Contest, or by any human error which may occur in the processing of Contest Entries. Incomplete Entries, or Entries containing false or fraudulent information, will be disqualified. Entries remain the property of Househappy and will not be returned or acknowledged.

All information collected through Entry into the Contest will be used only in accordance with Househappy's privacy notice at https://househappy.com/about/privacy-policy.   

Entry Restrictions.  Entries must not: (a) violate any third party rights, including, but not limited to, copyrights, trademark rights, or rights of privacy and publicity; (b) contain defamatory statements; (c) include threats to any person, place, business, or group; or (d) be obscene or indecent. Any elements that appear in the Entry, including, without limitation, images, text, or other materials used must be entirely original and created by the entrant, or be in the public domain. Use of any elements that are not original or in the public domain will result in disqualification of an Entry in Househappy’s sole discretion.

If an Entry depicts or features any other person, (i) you must have permission from that person to grant the rights to Househappy described in these Official Rules, and (ii) that person must be of the age of majority in his/her jurisdiction of residence, or if that person is a minor, you represent and warrant to Househappy that you are the parent or legal guardian of such minor.  By submitting an Entry, you represent that (a) you are the creator of the Entry, (b) you own all rights to the Entry, (c) the Entry does not infringe upon or violate the intellectual property, privacy, or other rights of any third party, (d) the Entry has not previously been entered in any other contest, and (e) the Entry has not been previously published in any medium.

Voting and Winner Selection.  During the period from December 3, 2020 at 12:01 am Pacific Time through December 6, 2020 at 11:59 pm Pacific Time (the "Voting Period"), Househappy will select 6 Entries that will be publicly displayed and posted on the Contest Page for public viewing and voting. Voters are asked to vote for the Entry which best captures the Thanksgiving theme. At the end of the Voting Period, the entry that receives the most votes from eligible voters will be declared the Contest winner. Votes entered or received after the Voting Period will not be counted.

An eligible voter must (a) have an active Househappy account, (b) be a legal U.S. resident 18 years of age or older, (c) successfully complete the voter registration process on the Contest Page, and (d) agree to all corresponding terms and conditions of voting. Only one vote per person will be allowed during the Voting Period. Househappy will track unique voters based on their email address, IP address, and cookies. Voters attempting to submit more than one vote will be disqualified and all votes submitted by such voter will not be counted.

All results are final and may not be appealed. Househappy will notify the winners via email or alternate method identified in the Entry. If a potential winner cannot be reached and/or does not respond to the Househappy within five (5) days from Househappy's first attempt to contact him/her, or if he/she is found to be ineligible or does not otherwise comply with these Official Rules, an alternate winner may be selected by the Househappy.

Prizes. The Contest winner receive the following prize:

One (1) $200 Househappy account credit (approximate retail value $200) for house cleaning.  No substitute, transfer, or cash equivalent for the prize is allowed by the winners. Househappy, at its sole discretion, may substitute prizes of equal or greater value.

License. By submitting an Entry, you: (a) irrevocably grant to Househappy the unconditional and perpetual non-exclusive right, license and permission to copyright, reproduce, encode, store, copy, transmit, publish, post, repost, reshare, broadcast, display, publicly perform, adapt, modify, create derivative works of, exhibit, and otherwise use your Entry as-is or as-edited (with or without using your name) in any media throughout the world for any purpose, without limitation, and without additional review, compensation, or approval from you or any other party; (b) forever waive any rights of copyrights, trademark rights, privacy rights, and any other legal or moral rights that may preclude Househappy’s use of your Entry, or require any further permission for Househappy to use the Entry; and (c) agree not to instigate, support, maintain, or authorize any action, claim, or lawsuit against Househappy on the grounds that any use of the Entry, or any derivative works, infringes any of your rights as creator of the Entry, including, without limitation, copyrights, trademark rights, and moral rights. Househappy has the right, but not the obligation, to use any Entry as described herein.

The winner’s Entry into the Contest and/or acceptance of a prize constitutes permission for Househappy to use the winner’s name, address (city and state) and/or likeness for advertising and trade purposes without further compensation, worldwide and in perpetuity, in any and all forms of media, now known and hereafter devised, including without limitation on-line and on Facebook and Instagram, unless prohibited by law.

Consent to Receive Email.  By participating in the Contest, you will opt-in to receive email or other communications from Househappy and its affiliated partners. You may subsequently opt-out of the receipt of such email or communications by following the directions in the email or contacting that site. Your opt-out status will not affect your participation or chances to win in the Contest. During the Entry Period, however, you may nevertheless receive emails which Househappy deems are related to the Contest and related programs.

General Conditions.  All Federal, state and local laws and regulations are applicable. All taxes (including, but not limited to, income taxes), and any and all service charges or fees applicable to the prize are the sole responsibility of the winners.  The prize winners may be required to execute (and have notarized) an Affidavit of Eligibility, a Liability Release, and/or a Publicity Release ("Affidavit/Release") which must be returned to and received by Househappy within ten (10) days from a winner’s receipt of the Affidavit/Release.  The winners may also be required to complete a Form 1099 before receiving their prize. The prize winners may also be required to send Househappy appropriate proof of age.  Any failure to comply with the foregoing will result in disqualification and an alternate winner may be chosen.  Return of the prize, the prize notification, or the Affidavit/Release as undeliverable will result in disqualification and an alternate winner will be selected.  Each winner’s Entry into the Contest and/or acceptance of the prize constitutes permission for Househappy and its affiliates to use the winner’s name, address (city and state) and/or likeness for advertising and trade purposes without further compensation, worldwide and in perpetuity, in any and all forms of media, now known and hereafter devised, including without limitation in Househappy's newsletters and on the Househappy's website, unless prohibited by law.  All entrants agree to comply with these Official Rules.  Any person attempting to defraud or in any way tamper with this Contest and any person who does not comply with these Official Rules, will be ineligible for the prize and may be prosecuted to the full extent of the law. 

THE OREGON COURTS (STATE AND FEDERAL) SHALL HAVE SOLE JURISDICTION OF ANY CONTROVERSIES REGARDING THE CONTEST AND THE LAWS OF THE STATE OF OREGON SHALL GOVERN THE CONTEST. EACH ENTRANT WAIVES ANY AND ALL OBJECTIONS TO JURISDICTION AND VENUE IN THOSE COURTS AND HEREBY SUBMITS TO THE JURISDICTION OF THOSE COURTS. 

If, for reasons beyond Househappy's control, the Contest is not capable of running as originally planned, such as tampering or bugs or infection by computer virus, Househappy at its sole discretion, reserves the right to suspend, cancel or modify the Contest, without liability.  Househappy is not responsible for its own, its third party service provider's, or any entrant's computer system, hardware, software or program malfunction or other errors, failures, delayed computer or email transmissions or network connections that are either human or technical in nature.

Disclaimers.  Entrants (and any minor entrant’s Parent/Guardian) agree that Househappy (A) shall not be responsible or liable for, and is hereby released from, any and all costs, injuries, losses or damages of any kind, including, without limitation, death and bodily injury, due in whole or in part, directly or indirectly, to participation in the Contest or any Contest-related activity, or from entrants’ acceptance, receipt, possession and/or use or misuse of the prize, and (B) has not made any warranty, representation or guarantee, express or implied, in fact or in law, with respect to the prize, including, without limitation, to such prize’s quality or fitness for a particular purpose.  Entrants also agree that neither Househappy is not responsible or liable for any injury or damage to an entrant's or third person's computer related to or resulting from the Contest or its prizes.  Househappy is not liable for damage to a user's computer system in any way due to an entrant's participation in the Contest or downloading any information in connection with the Contest, including without limitation any server failure, lost, delayed or corrupted data or other malfunction.  Househappy reserves the right to modify or cancel the Contest in the event that it becomes technically corrupted.
